Scope

For all business relationships between KunstohneEnde, hereinafter referred to as KoE, and the buyer, only the following General Terms and Conditions in their version valid at the time of the order shall apply. Deviating conditions of the buyer are not recognized by KoE unless KoE has expressly agreed to them in writing.

Conclusion of Contract

By placing an order with KoE, you are making a binding offer to conclude a purchase contract. We will confirm receipt of your order by sending a confirmation email (Order Confirmation). This confirmation does not constitute acceptance of your offer but is merely to inform you that your order has been received. The purchase contract is only concluded when the ordered product is shipped. Products not listed in the shipping documents are not subject to any purchase contract.

No Granting of Rights, Exhibitions

By purchasing an artwork, you only acquire ownership of the physical object. No additional usage rights are transferred. Any form of reproduction, distribution, rental, public accessibility, or other forms of exploitation, whether analog or digital, is prohibited. However, you are free to resell the artwork.

The public exhibition of purchased artworks requires the individual approval of the respective artist.

Retention of Title

The ordered goods remain the property of the artist until full payment has been made.

Liability

KoE is only liable if KoE or one of its agents has violated a material contractual obligation in a manner that endangers the contractual purpose, or if the damage is due to gross negligence or intent on the part of KoE or one of its agents. Unless gross negligence or intent is involved, KoE's liability is limited to the damage that was reasonably foreseeable at the time the contract was concluded.

Liability for assured characteristics, personal injury, and mandatory statutory provisions, particularly under the Product Liability Act, remains unaffected.

Warranty and Proper Handling

It is assumed that paintings, prints, and photographs may change in appearance and color and fade depending on environmental influences. KoE does not provide any warranty for this unavoidable process.

Otherwise, the statutory warranty period is 2 years and begins with the delivery of the goods. During this period, all defects covered by the statutory warranty obligation will be remedied free of charge. Excluded from the warranty are damages resulting from natural wear and tear, improper use, inadequate or incorrect care, or storage.

All objects should not be exposed to direct sunlight, immediate heat sources, or excessive humidity. They are therefore not suitable for outdoor areas, basements, bathrooms, or kitchens. Laminations with UV protection foil or acrylic glass and wooden frames are very sensitive to scratches and stains and should therefore only be handled with gloves or similar protection.

Collection, Processing, and Use of Personal Data

The data you provide is used to make your shopping experience at KoE personal and continuously improve it. We use your information to process orders, deliver goods, provide services, and process payments (including necessary checks for purchases on account). Furthermore, we use your data to communicate with you about orders, products, marketing offers, or the KoE newsletter, to update our records, manage and maintain customer accounts, display content such as wish lists or cart contents, and to recommend products or services that might interest you, provided you consent. Your information also serves to improve our offerings, prevent or detect misuse of our website, and allow third parties to provide technical, logistical, or other services on our behalf.

Applicable Law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is agreed to be the Commercial Court of Vienna.
